These Terms & Conditions ("Terms") form a legal agreement between you ("you," "your," "Client") and Belle Derma Skin Boutique, owned and operated by Aura Wellness Consulting ("Belle Derma," "we," "us," "our"). By accessing our website, booking a service, attending an event, or purchasing a product from us, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please do not use our website or services.

1. The Boutique & Our Services

Belle Derma is a clean beauty, advanced aesthetics, and holistic wellness boutique located in Calgary, Alberta. We offer signature facials, advanced aesthetic treatments, complimentary skincare consultations, memberships, retail products, educational events, and gift cards. All services are provided by qualified practitioners by appointment only.

2. Eligibility & Client Responsibility

You must be at least 18 years of age to book treatments, memberships, or events, or 16 years of age with the written consent of a parent or legal guardian who will accompany you to the appointment.

You agree to disclose, truthfully and completely, any and all medical conditions, allergies, sensitivities, medications, pregnancy, breastfeeding status, recent cosmetic procedures, and other factors that could reasonably affect the safety or suitability of a service. Belle Derma relies on this information in good faith and reserves the right to decline, modify, or discontinue any treatment where, in our professional judgement, it would not be in your best interest.

You acknowledge that our services are aesthetic and wellness in nature, not medical. We do not diagnose, treat, or cure any medical condition. If you have concerns about your health, please consult a licensed physician.

3. Expected Results

Skincare and aesthetic outcomes vary from individual to individual and depend on factors including skin type, lifestyle, age, consistency of care, and overall health. We provide our professional best effort but cannot and do not guarantee any specific outcome. Phrases on our website such as "may improve" or "helps soften the appearance of" are intended as general educational information, not as clinical claims or warranties.

4. Appointments & Cancellation Policy

4.1 Booking. A valid credit card is required to secure most appointments. For some services, a non-refundable deposit may be collected at the time of booking and applied to the final service fee.

4.2 Cancellations & Rescheduling. We respectfully require a minimum of twenty-four (24) hours' notice to cancel or reschedule an appointment. Cancellations made with less than 24 hours' notice, and no-shows, will be charged a fee of up to fifty percent (50%) of the booked service price to the card on file.

4.3 Late Arrivals. If you arrive more than fifteen (15) minutes late, your service may be shortened to end at the originally scheduled time, or rescheduled at our discretion, with the full service fee still applicable.

4.4 Memberships. Memberships are billed monthly in advance and continue until cancelled with thirty (30) days' written notice to [email protected]. Unused monthly services do not roll over unless expressly permitted.

4.5 Treatment Packages. Pre-paid treatment packages are valid for twelve (12) months from the date of purchase and are non-refundable once activated. Unused sessions within a package expire after that twelve-month period.

5. Complimentary Clean Beauty Skincare Consultation

Our Clean Beauty Skincare Consultation is offered complimentary, with no obligation to purchase. Consultations provide a personalised skincare protocol and product recommendations only, and do not constitute medical advice. The 24-hour cancellation policy in Section 4.2 applies to all consultations.

6. Pricing & Payment

All prices are stated in Canadian Dollars (CAD) and are subject to applicable Goods and Services Tax (GST). Prices, promotions, menu offerings, and product availability may change without notice. Payment is required at the time of booking, purchase, or checkout. We accept major credit cards and other payment methods displayed at the Boutique.

Service prices on our website reflect starting-from pricing. Final service pricing depends on the specific protocol selected and any add-on or combination treatments, and will be confirmed with you prior to beginning the service.

7. Returns, Exchanges & Refunds

7.1 Services. Fees for services that have been performed are non-refundable. If you have a concern about a service you received, please contact us within seven (7) days and we will work with you in good faith to make it right.

7.2 Retail Products. Due to the personal and hygienic nature of skincare, unopened, unused retail products returned in their original packaging may be exchanged (not refunded) within fourteen (14) days of purchase, with proof of purchase. Opened or used products may be returned only in the case of a verified product defect or documented allergic reaction, in accordance with the manufacturer's policy.

7.3 Gift Cards. Gift cards are non-refundable, non-transferable, cannot be redeemed for cash, and do not expire.

7.4 Deposits. Deposits paid to secure an appointment are non-refundable in the event of a no-show or late cancellation.

8. Monthly Learn & Shop Call and Other Events

Our Monthly Learn & Shop Call is a virtual educational event hosted by the Belle Derma experts. Content shared during the event is for general educational purposes only and is not a substitute for personalised professional or medical advice. By registering, you consent to receive event-related communications from us, which may include email reminders, replays, and offers available only to attendees. You may unsubscribe from event-related marketing at any time.

9. Website Use

You agree to use our website for lawful purposes only. You will not use our website in any manner that could damage, disable, overburden, or impair it or interfere with any other party's use of the site. Unauthorised attempts to access accounts, systems, or data are strictly prohibited.

10. Intellectual Property

All content on this website — including but not limited to text, imagery, logos, trademarks, visual design, formulations referenced, and layout — is owned by Belle Derma Skin Boutique and Aura Wellness Consulting, or is used under licence from the respective brand owners. You may not copy, reproduce, modify, distribute, publish, display, or create derivative works from any of this content for commercial purposes without our prior written permission.

11. Third-Party Brands & Links

We carry curated third-party clean beauty brands, including Esse Skincare and Om Organics, among others. All third-party product names, logos, and marks remain the property of their respective owners. Our website may contain links to third-party websites. We are not responsible for the content, policies, or practices of those third-party sites.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Belle Derma, its owners, practitioners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our website, services, products, or events. Our total aggregate liability to you for any claim arising from or related to these Terms shall not exceed the amount you actually paid to us for the specific service or product giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, or any other liability that cannot be lawfully excluded or limited.

13. Indemnification

You agree to indemnify and hold harmless Belle Derma and its related parties from and against any claims, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of our website, or your failure to disclose information material to the safety or suitability of a service.

14. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services or applicable law. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website, services, or events after a change takes effect constitutes your acceptance of the revised Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by, and construed in accordance with, the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law principles. You agree that any dispute arising from or relating to these Terms shall be resolved exclusively in the courts of the Province of Alberta located in Calgary, Alberta.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be struck or limited to the minimum extent necessary and the remaining provisions shall remain in full force and effect.

2.1 Information you provide directly. Name, email address, telephone number, mailing address, date of birth (for age verification where required), skin history and goals, health and medical disclosures necessary for safe treatment, treatment preferences and notes, consent forms, and payment information.

2.2 Information collected automatically through our website. IP address, device type, browser type and version, operating system, pages viewed, referral source, and anonymised analytics data about how our website is used.

2.3 Information from third parties. We may receive information from service providers acting on our behalf, such as our online booking platform, email service provider, or payment processor, strictly for the purposes of operating our services.

3. How We Use Your Personal Information

We use your personal information for the following purposes:

• To confirm, deliver, and follow up on your appointments, treatments, memberships, and events;
• To process purchases, memberships, gift cards, refunds, and billing;
• To prepare, maintain, and update your consultation notes and personalised skincare protocols;
• To respond to your enquiries and provide customer care;
• To send you educational content, the Belle Derma Seasonal Edit, event invitations, member-only offers, and promotions — only where you have expressly opted in, and you may opt out at any time;

You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link included in every marketing email, or by writing to [email protected]. Transactional communications (for example, appointment confirmations and treatment-related messages) are not marketing and will continue so that we can properly serve you.

9. Safeguarding Your Information

We maintain reasonable physical, administrative, and technological safeguards to protect personal information in our custody from loss, theft, and unauthorised access, use, disclosure, modification, or destruction. Clinical and consultation records are stored securely and are accessible only to practitioners involved in your care. Despite our safeguards, no transmission or storage system can be guaranteed 100% secure.

10. Retention of Personal Information

We retain personal information only as long as necessary to fulfil the purposes for which it was collected, to provide our services to you, and to comply with our legal, professional, and tax obligations. Clinical and treatment records are retained in accordance with professional standards applicable to our practice in Alberta. When personal information is no longer required, we securely destroy, erase, or anonymise it.

11. Your Rights & Access to Your Information

Under PIPEDA and PIPA, you have the right to:

• Request access to the personal information we hold about you;
• Request correction of personal information that is inaccurate or incomplete;
• Request deletion of personal information, subject to our legal and professional retention obligations;
• Withdraw your consent to further use or disclosure, subject to the same obligations;
• Ask questions about how your personal information is handled.

To exercise any of these rights, please write to our Privacy Lead at [email protected]. We may ask you to verify your identity before responding and will respond within thirty (30) days of a complete request. If we are unable to fulfil your request, we will explain why.

12. Children & Minors

Our services and website are intended for adults. We do not knowingly collect personal information from anyone under the age of 18 without the express consent of a parent or legal guardian.
